Idealmoments.co.uk is the on-line trading division of Netring Ltd.
The idealmoments.co.uk website is provided to you free of charge for your personal use subject to these Terms and Conditions. By using the idealmoments.co.uk website you agree to be bound by the following Terms and Conditions.
Idealmoments.co.uk website is made up of a number of sections, including eg, quilts. kitchenware, kitchen fragrances etc. These Terms and Conditions govern your use of the idealmoments.co.uk website and services provided in connection with these.
THESE TERMS AND CONDITIONS DO NOT AFFECT YOUR STATUTORY RIGHTS.
Description of Goods/Warranty and Liability
Although Idealmoments.co.uk warrant that the goods will, at the time of delivery, correspond to the description given by us all images, descriptive matter, specifications and advertising are for the sole purpose of giving an approximate description of the goods. Except where the Customer is dealing as a consumer (as defined in the Unfair Contract Terms Act 1977, section 12) all other warranties, conditions or terms relating to fitness for purpose, merchantability or conditions of the goods whether implied by Statute, Common Law or otherwise are excluded and the Customer warrants that the Customer is satisfied as to the Suitability of the Goods for the Customer's purpose Goods are not sold on a trial basis.
If you buy goods which have no published technical specifications, it is your responsibility to establish the suitability of the goods for your intended purpose.
In the event that a product is listed at an incorrect price due to a typographical error or error in pricing information from our suppliers, Idealmoments.co.uk shall have the right to refuse or cancel any orders based on the incorrect price whether or not the order has been confirmed.
Product Images / Specifications
Whilst Idealmoments.co.uk endeavour to ensure all images and specifications are correct at the time of publication, they do vary. As such Idealmoments.co.uk can accept no responsibility for incorrect images/information. If however you spot a mistake with an image or with a products specification please contact us immediately
This is a UK site only. Orders will only be accepted from UK residents for UK delivery, paid for with UK payment cards only. On the order you must provide us with your exact address and telephone number that your card issuer has on file for you. Your order will only be processed once authorisation of your card has been properly received.
Availability of Goods
All products are subject to availability and may be withdrawn at any time. However it is our policy to contact you if a product is out of stock and if you do not wish to proceed with the order or for any reason Idealmoments.co.uk cannot supply the product, Idealmoments.co.uk will arrange for the order to be cancelled.
Whilst every reasonable effort shall be made to keep any delivery date, time of delivery shall not be of the essence of the Idealmoments.co.uk delivery service. Idealmoments.co.uk shall not be liable for any losses, costs, damages or expenses incurred by the Customer or any other person or company arising directly or indirectly out of any failure to meet any estimated delivery date.
Delivery of the Goods shall be made to the Customer's address and the Customer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery.
If the Courier is unable to make a delivery to the address provided and if the parcel then still remains uncollected from the Royal Mail or Courier Depot and is returned to Idealmoments.co.uk , we will refund the price paid for the original order minus the original delivery charge and the delivery charge at cost back to our site.
Time Limitations for Notification of claims
Damaged in Transit
As internal damage cannot always be identified on delivery, the Customer must contact Idealmoments.co.uk within 48 hoiurs of receipt of delivery.
Idealmoments.co.uk cannot accept any claims for damage if the above time scales are not followed.
It is the Customers responsibility to sign for the correct number of packages that are delivered, the Customer is required to check that the number of packages delivered equal the number of packages on the delivery drivers manifest/consignment note. Any shortages must be noted on the drivers manifest and it is the Customers responsibility to thereafter notify us within 48 hours of delivery.
Should the Customer be missing an item but has signed for the correct number of packages. The Customer must notify us within 24 hours of delivery. The Customer will be requested to provide us with a copy of the invoice as well. The matter will be investigated and the Customer will be informed of the decision.
It is the Customers responsibility to notify us of any incorrect goods supplied within 24 hours of delivery. If the items are not as ordered, the Customer must not open the manufacturer's packaging or use the item. The Customer will also be required to provide further information on what was received i.e Idealmoments.co.uk may require the product codes and a full description of what has been received. Should there be any extenuating circumstances that has prohibited the Customer to remain within the specified time frame, resolution will be by mutual decision.
Idealmoments.co.uk will not accept liability for goods lost in transit unless Idealmoments.co.uk are notified within 7days from the expected delivery date. This will be the date advised on the Customers automated despatch note which is emailed to the Customer once the items have left our warehouse.
Idealmoments.co.uk shall accept no liability for shortages, non-deliveries, incorrect goods and goods damaged on delivery outside the reported timescales except when extenuating circumstances have prevented notification within the reported timescale. The extenuating circumstances must be by mutual agreement.
Delivery Failure at Customer's Address
Where a parcel is sent out for delivery by Fedex courier, if there is no reply from the address provided for delivery, Fedex will leave a card at that address asking the customer to contact the Fedex depot to arrange another delivery or provide an alternative delivery address. If no contact is received by Fedex from the customer a second attempt to deliver the parcel may be made if convenient to the depot and another card left. If no contact is received from the customer, Fedex will return the parcel to Ideal Moments normally after five days from the first delivery attempt..The parcel will not be sent out again. The cost of the goods will be refunded to the customer minus the full Fedex delivery and return charges incurred on the parcel in question. The customer will be informed of this action by e-mail. This total charge for a returned parcel with a standard delivery to the UK mainland is £6.95 including VAT. Other areas will incur a higher charge and will be related to the delivery area.
All products supplied are covered by the terms and conditions of the Original Manufacturers Guarantee for a period of 12 months or longer if relevant, this is in addition to the consumers statutory rights.
Cancellation of Orders
If a customer wishes to cancel an order this must be done within 7 days of the delivery of the goods. A refund will then be made within 30 days of canceling the order. It is the customers responsibility to pay for any delivery charges incurred returning the goods.
If a customer has not returned the item within 14 days after canceling the order. Idealmoments.co.uk will then act to retrieve the goods. Any costs involved in this process will be past onto the customer.
If the items are accepted, opened and used the Distance Selling Regulations will apply. In all instances, goods must be returned as new, with no blemish, defect or parts missing, all manufacturer packaging should also be returned.
Items no longer required (Not applicable for Faulty Goods)
If you wish to return your order after the above 7 day cancellation period the following procedure must be followed.
The Customer will be responsible for the safe return of the goods. Goods must be returned “as new” or in the same condition that they were received in. There should be no damage, all parts, items should be returned, all packaging must be included and the manufacturer packaging must not be defaced in manner.
The Customer cannot return items that are not under the cover of a Returns Authorisation (RA). The RA request must be made by e-mail to firstname.lastname@example.org stating the reason for the return. Only once the RA has been authorised by a return e-mail do idealmoments.co.uk accept that the item(s) may be returned. The RA number must be clearly marked on the outer packaging only and not on the manufacturer packaging. Any item returned not under the cover of an RA number will be rejected. Idealmoments.co.uk do not pay for the cost of returning the items back to our site. If the order is cancelled outside of the 7 day cancellation period carriage charges applied to the initial order will not be refunded.
Only complete products will be accepted. Therefore ensure that all additional enclosures, such as manuals, are returned. Adequate packaging must be used to return the goods without damage.
Adequate packaging constitutes that the item is wrapped securely and then placed inside a box in order for the item to return to us with no internal or external damage. Items that are not securely wrapped and received will not be subject to a refund.
Idealmoments.co.uk reserves the right to reject and item(s) that do not meet the criteria laid out above.
A restocking fee of up to 25% of the original invoice value will be levied on item(s) returned after 7 days of the goods being delivered.
We strongly recommend that you use a recorded method of delivery.
Our policy on faulty goods is to obtain them (you must contact us within 24 hours to advise us of any fault/damage to the goods. We will advise you of the desired method for returning the item to us ) and test them for the reported faults. If the reported faults are apparent, the product cost and delivery costs will be refunded.
Returns which prove to be non-defective will be handled as outlined in the section 'Items no longer required'.
If for any reason you are issued with a refund, please note the following,
- All refunds will be issued to the same payment method as on the original order.
- When a refund is processed, you will receive an email notification.
- A refund will usually reach your card account within 4 working days after being processed but please allow up to 10 working days for it to be credited. Idealmoments.co.uk do however reserve the right to refund you within 30 days of the return.
- If you are told by us to send the item back using RoyalMail then we will refund the return postage cost via cheque (this will only happen if you have contacted us before hand and we have agreed in writing that we want you to send the item back to us in this way.)
Except as may be implied by law and except in the case of death or personal injury where the Customer is dealing as a consumer, in the event of any breach of these Terms and Conditions by us the remedies to you shall be limited to damages which shall in no circumstances exceed the price of the Goods and idealmoments.co.uk shall under no circumstances be liable for any indirect, incidental or consequential damages.
|You must quote the offer code when placing the order online or via phone. Your order value must be at least equal to the amount stated in the offers (i.e. £60+, £100+ and £150+). If you later return items from your order that in turn bring the total order value below the qualification limit of the offer taken then we reserve the right to charge the full retail price of the free gift chosen. This will be deducted from the refund due to you for any returned items. Gifts are limited to one per customer, while stocks last. We reserve the right to withdraw the offer at any time and to substitute any free gift with a product of equal or greater value.|
Idealmoments.co.uk will not be under any liability whatsoever in the event that idealmoments.co.uk are prevented or delayed from supplying or making delivery of any Goods by any reason or cause beyond our control.
Our failure to insist upon strict performance of any provision of these Terms and Conditions shall not be deemed to be a waiver of our rights or remedies in respect of any present or future default of the Customer in performance or compliance with any of these Terms and Conditions.
2. Updates to idealmoments.co.uk website
Idealmoments.co.uk may update these Terms and Conditions from time to time and any changes will be listed on the idealmoments.co.uk website. The changes will apply to the use of the idealmoments.co.uk website after idealmoments.co.uk have listed the terms and conditions. If you do not wish to accept the new Terms and Conditions you should not continue to use the idealmoments.co.uk website and the Online Store. If you continue to use the idealmoments.co.uk websiteafter the date on which the change has been listed, your use of the idealmoments.co.uk website indicates your agreement to be bound by the new Terms and Conditions.
To register with idealmoments.co.uk website you must be over eighteen years of age.
You must ensure that the details provided by you on registration or at any time are correct and complete.

4. Password and security

5. Refunds on promotional offers
Refunds for goods purchased under a promotional offer will be based on the terms of the promotional price. Your statutory rights are not affected.
6. Excluded Services
The services provided by the idealmoments.co.uk website do not include the provision of computer or other necessary equipment to access the idealmoments.co.uk.com website. To use the idealmoments.co.uk site you will require Internet connectivity and appropriate telecommunication links. Idealmoments.co.uk shall not be liable for any telephone or other costs that you may incur.
7. Intellectual property

Our acceptance of an order takes place on despatch of the order, at which point the purchase contract will be made and you will be charged for your order.
10. Third Party Websites
As a convenience to idealmoments.co.uk website customers, the idealmoments.co.uk website includes links to other web sites or material which are beyond its control. Idealmoments.co.uk website is not responsible for content on the Internet or World Wide Web pages outside the idealmoments.co.uk website.
11. Applicable Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and any disputes will be decided only by the English courts.
12. International Use
Idealmoments.co.uk makes no promise that materials on the idealmoments.co.uk are appropriate or available for use in locations outside the United Kingdom, and accessing the idealmoments.co.uk website from territories where its contents are illegal or unlawful is prohibited. If you choose to access this site from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.
13. Expiry Date on Payment Card
Please ensure that the expiry date of your payment card is after the anticipated despatch date of your order. Payment is taken at the point of despatch for goods and in the event that the payment card has expired idealmoments.co.uk will be unable to take payment and fulfill your order.
You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.
If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.
If you breach these Terms and Conditions and idealmoments.co.uk ignores this, idealmoments.co.uk will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.
Idealmoments.co.uk shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its control.
A person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.
